The penalties vary depending on the number of workers involved or recurrence of the failures in specified time intervals.
For example, the refusal of the rest period at least 11 hours in 24 hours will cost the employer Working from 50 to 150 euro if it concerns a maximum of five employees or if there was (even for a single worker) for not more than two periods of 24 hours.
The penalty is increased from € 300 to 1,000 if the failure to rest covered for 6 to 10 workers, or there is (even for a single worker) in 3 or 4 periods of 24 hours, to increase in size from 900 to 1,500 euro if they are interested in more than 10 workers or at least 5 periods of 24 hours. In the latter case you can pay a reduced (or twice the minimum one third of the maximum), as required by law 689/81 (Article 16).
The penalty is established at a fixed rate for "classes of offenses." It should not be multiplied by the number of employees involved.
For violations on the extension of the maximum weekly working time and the denial of weekly rest period of 24 hours every seven days (or on average every 14 days) the graduation of penalties shall be determined in relation to the number of persons involved and the recurrence of violations in the time that coincides with the reference for calculating average working week.
The Ministry stated that the calculation of the employees affected by violations of the time legislation is due to head, with no re-proportioning for part-time employees. To offenses committed before November 24 shall continue to apply the system of sanctions in force until then.
